Case 1: Holden Conner Realty - Request for Review of Permit Denial. Shelly Evans, agent for Holden Conner Realty, requested on February 24, 2004, a review of the Memphis District's decision to deny their proposed conversion of a two-acre wetland site to agriculture use. The Mississippi Valley Division (MVD) decided on September 1, 2004, that Mr. Conner's appeal is without merit. Case 2: Holden-Conner Properties - Request for Jurisdictional Appeal. On October 3, 2003, Lucie Brackin, agent for Holden-Conner Properties, requested an appeal of a jurisdictional determination. The applicant contends that two wetland areas, totaling approximately 9.8 acres, are isolated and not subject to Corps jurisdiction. The project site is located in Woodruff County, Arkansas. On June 8, 2004, the Mississippi Valley Division (MVD) remanded the case to the Memphis District to complete a jurisdiction determination (JD) on Mr. Conner's property in question. The District relied on a determination by NRCS that the areas are wetlands. After a site review on July 26, 2004, the District determined the extent of wetlands as determined by NRCS is correct. The applicant was advised by letter of August 31, 2004, that this determination completed the appeal procedure. Case 3: On January 21, 2003, Mobley Construction Company appealed a proffered permit for sand and gravel mining in the White River. The Mississippi Valley Division (MVD) found the appeal to be without merit on August 27, 2003. Case 4: John Stevens - Mr. John Stevens submitted an appeal to MVD on July 11, 2005, to review the Memphis District's decision to exert jurisdiction over approximately five acres of wetlands in an old pond site in White County, Arkansas. By letter dated October 27, 2005, MVD upheld the District's jurisdictional determination. Case 5: Marty Bennett - Mr. Marty Bennett submitted an appeal to MVD by letter dated October 5, 2005, to review the Memphis District's decision to exert jurisdiction over a wooded site near Aubrey, Arkansas, which he had proposed to clear for agriculture. Case 6 - Mr. Mike Skelton - Mr. Skelton submitted a request for appeal of a jurisdictional determination to MVD on November 25, 2005, pertaining to ponds proposed to be filled and a nearby unnamed tributary. MVD remanded the case to the Memphis District to further document if the ponds and tributary are considered waters of the U.S. and regulated by the Corps of Engineers.
